Reporting Copyright Infringement

If you believe that your copyright or the copyright of someone you represent has been infringed upon by our service, we encourage you to inform us immediately. Please reach out to us via email at dmca@southdakotapdfs.com with a detailed description of the alleged infringement. Your notification should include the following information:

  • A clear identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.

  • Identification of the material that is claimed to be infringing, including information that will help us locate the material on our website.

  • Your contact information, including address, telephone number, and, if available, email address.

  • A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Our Response

Upon receiving a proper notification of claimed infringement, SD PDF Forms takes swift action to address the issue. Our steps include:

  • Removing or disabling access to the infringing material.

  • Notifying the uploader of the material about the takedown, if identifiable.

  • Initiating an internal review to assess the validity of the complaint.

Further actions, including permanent deletion of the infringing material or suspension of the involved service, may be taken based on the outcome of our review.

Counter-Notification

If you believe that your content was mistakenly identified as infringing, or if you believe you have the legal rights to use and distribute the content (e.g., due to a license or fair use), you have the right to send us a counter-notification. Similar to your original infringement notification, your counter-notification should be sent to dmca@southdakotapdfs.com and must include:

  • Your physical or electronic signature.

  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.

  • A statement under penalty of perjury that you believe in good faith that the material was removed or disabled as a result of mistake or misidentification.

  • Your name, address, telephone number, and, if available, an email address at which you may be contacted.

  • A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

Upon receipt of a counter-notification, SD PDF Forms will provide the original complainant with a copy of the counter-notification and inform them that we may replace the removed content or cease disabling access to it in 10 business days. The removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our discretion.
